UNCA Officials Refuse to Answer Questions

Going straight to the heart of the current bathroom controversy, Project Veritas went undercover in North Carolina and released a video exposing university officials and the UNCA Title IX Administrator turning a blind eye to hypothetical sexual exploitation.

On May 2, 2016, Project Veritas sent a FOIA request to Heather Parlier, the General Counsel at UNC Asheville requesting an opportunity to inspect and obtain copies of public records that pertain to the Incident/Investigation report that UNCA reportedly filed on April 14, 2016 at 17:52. We requested all redacted information from the “Incident/Investigation Report” as well as any related official reports that had Chief Boyce’s signature on them. We also requested any hand written notes, emails, and computer entries pertaining to the filing of this incident report, as well as any data relevant to this incident that was inserted into the “Southern Software Compliance Center Crime Log” on the UNCA website.

On May 4, 2016 Ms. Parlier denied our request for the redacted information citing North Carolina General Statutes (NCGS) 132. However, she did not provide us with information regarding the incident being inserted into the “Southern Software Compliance Center Crime Log” on the UNCA website. It is interesting to note that while there is an unsigned police report, there is also no entry of the alleged incident in the campus crime log. Project Veritas contacted UNC Asheville several times and left numerous voicemails requesting a comment but nobody has returned our calls.

With a questionable data log and a missing signature from the police chief, one may ask whether or not the alleged police report and investigation is truly valid. You decide.

Below is the correspondence from Ms. Parlier in which she denied our FOIA request:

Ms. [Project Veritas employee],

I write in response to your request for records pursuant to North Carolina General Statutes (NCGS) 132.

On April 29, 2016, Stephen Gordon from Project Veritas requested “any police report filed in regard to a transgender bathroom issue on or after April 14, 2016.”  UNC Asheville provided a response to that request, and I have attached a copy of the report to this email.  Pursuant to NCGS 132-1.4, portions of the report were redacted.

On May 2, 2016, you and I spoke regarding the report received by Project Veritas.  Later on May 2nd, you sent a written request for records pursuant to the North Carolina Public Records Law (NCGS 132).  I write in response to your phone call and written request.  As discussed above, the redacted information from the report is redacted pursuant to NCGS 132-1.4.  The other records you request in your letter dated May 2, 2016, do not exist or are otherwise not public records under NCGS 132.  In our phone conversation, you asked for the date and time the report was filed, this information is contained in the attached report.
